Through the course of his 48-year legal career, Mr. Prosser has served as a state litigator, private practice attorney, Republican legislator, and a justice for the state of Wisconsin. His particular expertise was with criminal law and statutory interpretation during his 18 years as a Justice of the Supreme Court of Wisconsin. Mr. Prosser attributes his success to persevering through resistance. His career included the first statewide candidate recount in Wisconsin, where he won by 7,000 votes in the general election after 14,000 votes were discovered unreported.
Mr. Prosser was born in Chicago in 1942 to David Thomas Sr. and Elizabeth Averell Prosser. He has been interested in politics since he was 9 years old, and never diminished that interest since he received a telegram from Dwight D. Eisenhower. Riding on those high hopes, he attended DePauw University to earn a BA in 1965. He received a JD from the University of Wisconsin in 1968, and briefly served as a lecturer at the Indiana University Indianapolis Law School. In 1969, he was selected to work as an advisor for the U.S. Department of Justice in Washington. In the early '70s, he served as an administrative assistant to U.S. Representative Harold V. Froehlich, and launched his private practice in 1975.
In 1976, Mr. Prosser returned to his home in Appleton, Wisconsin, where he was elected as the District Attorney for Outagamie County. Beginning in 1979 he served 18 years as a Republican legislator with the Wisconsin State Assembly representing the Appleton area. Mr. Prosser held the role of minority leader from 1989 to 1994, and was the speaker of the assembly from 1995 to 1996. He also served on the Wisconsin Sesquicentennial Commission.
In 1997, Governor Tommy Thompson appointed Mr. Prosser to the Tax Appeals Commission. In 1998, the governor appointed Mr. Prosser to the Wisconsin Supreme Court. Mr. Prosser served as a justice on the court until 2016, He also was a commissioner with the National Conference of Commissioners on Uniform State Laws for more than 20 years. In 2016, the Wisconsin Supreme Court named the Wisconsin State Law Library in his honor.
Mr. Prosser is a member of many legal organizations, including Wisconsin Bar Association and Wisconsin Law Foundation. He was selected for inclusion in numerous volumes of Who's Who in America, Who's Who in American Law, Who's Who in American Politics, Who's Who in the Midwest, and two volumes of Who's Who in the World from 2010 to 2011.
