Prior to entering private practice, Mr. Smithson was employed for 29 years as a Staff Attorney, Trial Attorney and Supervisory Staff Attorney at the Office of Hearings and Appeals, representing the Social Security Administration in agency disability hearings and in oral arguments in Federal Court.
Mr. Smithson is a 1971 cum laude graduate of Furman University. He obtained his JD at the University of South Carolina in 1975. While employed at the Office of Hearings & Appeals, he often lectured at South Carolina Bar Continuing Legal Education seminars on Social Security law and how to properly represent disability clients before the agency. He used that experience upon entering private practice in 2006 to represent disabled clients before the Hearing Office and in Federal Court. Mr. Smithson discovered that private practice required many more hours but was much more personally rewarding because of the satisfaction derived from helping people in often desperate straits. In 2013, he won a hard-fought case which resulted in one of the largest awards of retroactive disability benefits ever ordered by a federal court for the District of South Carolina.
As a respected voice in the field, Mr. Smithson has been recognized throughout his career for his contributions, and is an AVVO-rated attorney. With fewer than 20 cases still open, he intends to soon retire in order to pursue his other passions, including travel, singing in a men's choir, and playing in and managing adult baseball leagues.
