He has appeared in state and federal trial and appellate courts, including successfully arguing twice before the U.S. Supreme Court, in many significant labor and employment law matters.
His practice includes a wide variety of matters involving union management relations as well as employment discrimination. Mr. Fasman has extensive experience before the National Labor Relations Board and has negotiated collective bargaining agreements with many of the major labor unions in the United States. Prior to becoming a partner with Proskauer Rose, he was a partner at Paul, Hastings LLP, from 1988 to 2014. He also gained experience handling complex labor matters as a partner at Crowell & Moring LLP, and at Seyfarth Shaw LLP, where he began his career.
In addition to being a frequent speaker at industry events and academic conferences, Mr. Fasman has taught labor and employment law to members of the federal judiciary on behalf of the Federal Judicial Center and has been a guest lecturer at numerous law schools. He has contributed articles to the New York Law Journal and is the author of "What Business Must Know about the Americans with Disabilities Act" and the co-author of The Employment Law Compliance Handbook. He is a member of the American Bar Association's Committee on the Development of the Law under the National Labor Relations Act, as well as its International Labor and Employment Law Committee. He is also member of The American Law Institute and the American Bar Foundation, and is on the Board of Advisors of the New York University Law School Center for Labor and Employment Law.
Mr. Fasman received a Bachelor of Arts from Northwestern University and a Doctor of Jurisprudence from the University of Michigan Law School, where he graduated with Honors and was a member of the Order of the Coif. Mr. Fasman has been admitted to practice before the U.S. Supreme Court, the U.S. Court of Appeals for the Second, Fourth, Sixth, Seventh, Ninth, Eleventh and D.C. Circuits, as well as the bars of Illinois, New York and the District of Columbia. He has earned a Preeminent AV-Rating from Martindale-Hubbell for more than 25 years and has been admitted to the Employment Law Hall of Fame by Lawdragon.
