A court-appointed trustee under the Securities Investor Protection Act (SIPA) in the liquidation of Bernard L. Madoff Investment Securities (BLMIS) LLC since 2008, Mr. Picard has been working diligently over the past decade on this unprecedented global recovery effort resulting as one of the largest financial frauds in United States history. Tasked with recovering the principal stolen by Mr. Madoff to return to BLMIS customers with allowed claims, as of December 2017, Mr. Picard, with the help of his legal team, has recovered or entered into agreements to recover more than $13.3 billion, all of which will be returned to defrauded BLMIS customers. To date, he has overseen the return of more than $11.069 billion to BLMIS customers, which includes approximately $844.9 million in cash advances from SIPC. Outside of his work with the BLMIS, Mr. Picard has served as a court-appointed trustee in 11 securities brokerage house liquidations under SIPA, served as the first U.S. trustee for the Southern District of New York between 1979 and 1982 and served as an assistant general counsel for the Securities Exchange Commission between 1976 and 1979.
During his career, Mr. Picard has been a contributing author to "Collier on Bankruptcy," a legal publication, on matters of stockbroker liquidations, as well as the DePaul Law Review. His legal background has also been extensively interviewed and reported on by some of the major media outlets over the years, including CBS 60 Minutes, ABC Nightly News, Bloomberg TV, the Wall Street Journal and the Associate Press, among others.
Mr. Picard is an associate member of the National Association of Bankruptcy Trustees and longtime member of the American Bar Association, the Federal Bar Council, the American Bankruptcy Institute, and the National Association of Federal Equity Receivers, among several other professional organizations.
The recipient of a 2017 Leadership in Credit Education Award by the New York Institute of Credit, named a 2014 Litigation Star by Benchmark Litigation and the winner of a 2014 Silver Shingle Award for Service to the Profession by Boston University School of Law, Mr. Picard has also been highlighted by several professional law publications.
