Mr. Wacks concentrates his practice in estate planning and taxation of estates, real property transactions, trusts for persons with disabilities, elder law and estate administration, legal matters involving closely held businesses and as counsel to New Jersey municipalities. He supervises the review of all bank-related transactions, including real estate loans and loan workout matters and frequently serves as an expert in court related matters in his chosen fields of law. Mr. Wacks has been recognized as an expert by the New Jersey Supreme Court, the Federal District Courts of New Jersey and by the Office of Administrative Law on legal ethics, in the creation of trusts and estates, mortgage banker and broker law, title insurance matters and the taxation of estates. In his capacity as an expert he has contributed over 200 legal opinions regarding the responsibility of attorneys in relationship to clients and non-client in these fields of law. Mr. Wacks has handled more than 8,000 real estate transactions for buyers, sellers, developers and mortgagees. Mr. Wacks has personally assisted more than 1,000 families in planning their estates and dealing with the issues of business succession.
Since 1971, Mr. Wacks has served as a counsel to the Borough of Rockaway and since 1987, as counsel to the Township of Allamuchy, New Jersey. He was appointed as the municipal attorney for the Township of Frelinghuysen in 1998 and still holds that position. He has represented these communities in all phases of municipal law, attended hearings as a result of a court-imposed sewer and building moratorium, drafted bond ordinances, general ordinances and resolutions. He has appeared on behalf of these communities in cases involving municipal tax appeals and planned unit developments.
Mr. Wacks served as the former chairman of the District 10 Ethics committee for the Supreme Court of New Jersey. He is a past president of the Morris County Bar Association, a member of the Estate Planning Council of Northern New Jersey and a member of the American Bar Association's Center for Professional Responsibility.
Holding an AV-Preeminent Rating by Martindale-Hubbell since 1973, Mr. Wacks has been recognized as a Five Star Wealth Manager in 2001, among New Jersey's Super Lawyers by his peers, and one of New Jersey's Legal Leaders by the Wall Street Journal. He was additionally honored among the Top 1% in 2016 of America's Most Honored Professionals. The elder law division of the American Institute of Legal Counsel also presented Mr. Wacks with the Client Satisfaction Award.
An Advisor to the Boston Symphony Orchestra, Mr. Wacks co-chaired their Planned Giving Committee and now serves on the Board of Trustees Philanthropy Committee. He is a trustee of the Gorham Foundation. He has been recognized for 15 years of continuous service as general counsel to the United Way of Morris County. Having completed service in the United States military, he graduated with a Doctor of Jurisprudence from Rutgers Law School, Newark, In his free time, Mr. Wacks enjoys attending classical music concerts, working in his flower and vegetable gardens, honing his photography skills and spending time with his family.
