He focuses on appellate litigation, the First Amendment, restitution and remedies, and the conflict of laws. A graduate of the University of California at Berkeley with a BA in economics (1955), and Harvard Law School with a JD (1960), he also holds an honorary LLD degree from the University of South Carolina (2007). Between college and law school, he served on active duty in the U.S. Marine Corps. After graduating from law school, Mr. Traynor served as a deputy attorney general of California for three years, including service in the Governor's office and as Special Counsel to the California Senate Committee on Local Government, and then joined the Cooley law firm for forty-five years, first as an associate, then as a partner, and then as senior counsel before retiring from that firm.
Mr. Traynor is a Fellow of the American Academy of Arts & Sciences, the American Academy of Appellate Lawyers, the California Academy of Appellate Lawyers, and the American Association for the Advancement of Science. He is president emeritus of the American Law Institute, a recipient of its Distinguished Service Award, and serves currently as an adviser on its Restatement Third of the Conflict of Laws. In 2004, he received the John P. Frank Outstanding Lawyer Award from the U.S. Court of Appeals for the Ninth Circuit, which recognizes a lawyer who has "demonstrated outstanding character and integrity; dedication to the rule of law; proficiency as a trial and appellate lawyer; success in promoting collegiality among members of the bench and bar; and a lifetime of service to the federal courts of the Ninth Circuit." He is an honorary lifetime trustee of the Lawyers Committee for Civil Rights Under Law, a past president (1973) of the Bar Association of San Francisco, and a past member of the board of overseers of the RAND Institute of Civil Justice. He served as co-chair (with Jamie Gorelick) of the ABA Commission on Ethics 2020, which reported on the impact of globalization and technology on the legal profession and recommended changes to the Model Rules of Professional Conduct, which were adopted by the ABA House of Delegates. For many years, he served as a volunteer mediator for the U.S. District Court for the Northern District of California.
In addition to his professional legal contributions, Mr. Traynor is an environmentalist and an educator. He is an honorary life trustee of Earthjustice and serves on its Council; a member of the Leadership Council and past board member of the Environmental Law Institute; a member of the advisory board of Sustainable Conservation; and a past co-chair (with William K. Reilly) of the California Commission for a Unified Statute. He has also taught law as a lecturer at the University of California at Berkeley Law School (remedies; conflict of laws) and in various continuing legal education programs; served as a member of the ABA Task Force on Long Term Legal Education (the "MacRate Report"), and has served on educational boards, including the Head-Royce School, the Berkeley Community Fund, the Center for the Collaborative Classroom, and Heyday. Esteemed as a mentor, he has helped foster the careers of many young lawyers. He contributes regularly to professional publications, which have published over one hundred of his articles and essays.
Mr. Traynor lives in Berkeley, California, with his wife Shirley W. Traynor, a retired clinical psychologist. Married in 1956, they have three children and four grandchildren.
