Mr. Swinton's impressive career has led him to represent more than 80 franchisors and more than 30 current or prospective franchisees and, on occasion, act as an arbitrator and mediator charged with resolving their differences. He has extensive experience in drafting and interpreting franchise agreements, as well as disclosure documents that are required by federal law and the throughout many states. Mr. Swinton is equally versed in creating documentation for franchisors, which solve problems before they arise, and in representing both prospective and current franchisees in their negotiations and dispute resolution.
A visionary and leader behind numerous community initiatives, Mr. Swinton was recently appointed executive secretary of the Utah Area Presidency in 2019. He is a former Visitors' Center Director of Laie, Hawaii Temple, the president of the England London South Mission, the chairman of the Pioneer Region Welfare Committee and a board director of the Homeless Youth Resource Center. He has served in various other roles with such organizations as the President of the Work Activities Center for Handicapped Adults and a District Chair of the Boy Scouts of America in Salt Lake City, Chairman of the Utah State Board of Services for People with Disabilities, an Area Seventy, State President and a Bishop Church of Jesus Christ of Latter-Day Saints. What's more, Mr. Swinton enlisted as a U.S. Army Reservist for 8 years, between 1966 and 1974.
An alumnus of the University of Utah, Mr. Swinton achieved both a Bachelor of Arts in 1971 and a Doctor of Jurisprudence in 1974. While pursuing his studies, he served as an associate editor of the Utah Bar Journal and an editor of the Journal of Utah Law. Mr. Swinton has since been admitted to practice by the Utah Bar Association, the U.S. Federal District Court for Utah, the U.S. Court of Appeals for the 10th Circuit and the Supreme Court of the United States.
A member and former two-time chairman of the franchise law section of the Utah State Bar, Mr. Swinton was also a member and arbitrator for the National Futures Association and a member and past president of the Society of Bar and Gavel. He has been a member of the American Bar Association and the Association of Trial Lawyers of America.
