Having accrued over 40 years of professional experience in international trade law, Mr. Shelley recently retired as a partner from Steptoe & Johnson, LLP in Washington, DC, where he had been since 1999. Prior to Steptoe, he excelled as a partner in the Washington law firms of Howrey & Simon from 1986 to 1999 and Plaia & Schaumberg from 1979 to 1986. Between 1976 and 1979, Mr. Shelley was an international trade negotiator, stationed in Geneva, Switzerland, during the Tokyo Round of GATT International Trade Negotiations for the Office of the United States Special Trade Representative. This round of negotiations lay the foundation for the current World Trade Organization. He also served the government in his earlier posts as an international trade specialist and an assistant to the director of the Office of Tariff Affairs for the U.S. Department of the Treasury from 1974 to 1976. His career began as an attorney-advisor for the U.S. Tariff Commission in 1973, the predecessor of the current U.S. International Trade Commission.
Before the years as a U.S. trade negotiator, Mr. Shelley's work included diverse responsibilities pertaining to enforcement of U.S. trade laws and representation of private parties' rights under the trade laws. At Treasury, Mr. Shelley investigated various allegations regarding the impact of actions by foreign countries on exports to the United States. During that time, among other countries, he travelled to India, Poland, Argentina, Hungary and Switzerland for such activities. He also was appointed as a panelist under the U.S. Canada Free Trade Agreement, which preceded the NAFTA trade agreement that also included Mexico. Panels were designed to resolve disputes between Canada and the United States in the implementation of trade remedies, as an alternative to filing judicial appeals.
During over thirty-five years in private practice, Mr. Shelley represented multiple domestic and foreign corporations involved in disputes regarding international trade laws. Examples include actions to protect the owner of the United States copyrights to the video games "Pac Man", "Galaxian", etc. against infringing imports of these products under Section 337 of the Tariff Act of 1930. Likewise, under section 337, Mr. Shelley was lead counsel in a major action to address the illegal importation of gray market bearings, in violation of the U.S. trademark laws.
Under the U.S. antidumping and countervailing duty laws, Mr. Shelley represented clients in many industries, including importers of table wine from France, Germany and Italy; footwear from Spain, Brazil and Argentina; bicycles from Taiwan; industrial chemicals from Germany; fork lift trucks from Korea and steel from Germany. His largest and longest representation under the antidumping law pertained to industrial bearing imports from Sweden, Germany.
France, Italy and the United Kingdom. Through annual government reviews and judicial litigation of government decisions, representation in the bearing disputes lasted over 25 years. During that period, due to acquisitions, new bearing cases on imports from China became part of the portfolio.
All the administrative international trade cases led to multitudes of judicial appeals, first, to the Court of International Trade in New York, and then, to the Court of Appeals for the Federal Circuit in Washington, DC. Overall, Mr. Shelley was lead counsel in over 200 judicial cases during his career. His final oral argument at the Federal Circuit was made in September, 2019.
Prior to his professional career, Mr. Shelley attended Columbia College in the City of New York, earning a Bachelor of Arts in 1969 in political science. He then attended the Vanderbilt University School of Law, from which he obtained a Doctor of Jurisprudence in 1972. His education concluded in 1973, when he graduated, magna cum laude, from the Vrije Universiteit Brussel with a Master of Laws in international and comparative law.
Outside of his immediate professional responsibilities, Mr. Shelley was a member of the American Bar Association, the District of Columbia Bar, and the Maryland State Bar. He also participated in the Steptoe pro bono program for many years, representing clients with legal appeals of immigration issues and developing draft rights agreements for use in for eventual use in certain Eastern European countries. Mr. Shelley found success as an international trade negotiator participating in the development of an international framework controlling the flow of trade throughout the world. He found that participating in the process of the negotiation of international trade rules, the implementation of them into U.S. law and the eventual application of the rules representing private clients before U.S. government agencies and courts for private clients has been a fulfilling career. Having been raised in Wyoming, it was not always his intention to study law, but working as a law librarian during his last two years of college at the New York firm of Paul, Weiss instilled the desire to be a lawyer.
