Prior to establishing The Wagner Law Firm in February 2010, Mr. Wagner started out his career in the mid 90's as an assistant state prosecutor for Harrison County, West Virginia, where he obtained immediate courtroom experience. In the fall of 1999, Mr. Wagner moved back to his hometown area of Martinsburg, West Virginia where he started working for an established criminal defense firm. In 2003, Mr. Wagner became a partner of the firm, which at the time was considered to be the largest criminal defense firm in the state. During this period, Mr. Wagner also handled all of the DUI cases within the firm in addition to numerous other "general criminal defense cases." It is here that Mr. Wagner honed his training and expertise in the area of DUI defense. In the Winter of 2010, Mr. Wagner resigned from his position to jump out on his own to open West Virginia's only criminal defense firm that is exclusive to DUI defense and DUI related cases.
Mr. Wagner is the current 2021 President-Elect of the national DUI Defense Lawyers Association, where he is also distinguished as a founding member. He is also affiliated with the National College for DUI Defense as a lifetime sustaining member where he previously served on the faculty and as the West Virginia state delegate for more than 10 years. Mr. Wagner has lectured throughout the country at state and national DUI seminars on numerous occasions and continues to do so. A devoted and compassionate defense attorney, Mr. Wagner is proud to have helped many good people endure the worst period of their lives. In accounting for his standout success, he credits the influence of his wife and two sons, who consistently motivate him to be the best he can be. Among his most notable professional achievements, Mr. Wagner was involved in a 2012 case that took place before the West Virginia Supreme Court. A special session held at the West Virginia University School of Law, where four cases were specifically chosen by the state high court. It involved the use of statewide breathalyzer machines and the unfair advantage that the state had against defendants restricting the accused citizen from access to the machine's inner workings, commonly referred to as "download data," which often times reveals machine errors that would other not be known but to the state's technician. In a 5-0 unanimous decision, the case concluded that any citizen accused of a DUI in the state of West Virginia that agrees to a breath machine is entitled to this data upon request. Becoming an author for the first time, Mr. Wagner published the first edition of the 2010 book, "West Virginia DUI Defense: The Law and Practice." The handbook is utilized by state officials throughout the state, from magistrates and judges to defense attorneys, prosecutors and law enforcement officials. Mr. Wagner is currently in the process of completing its second edition.
Mr. Wagner prepared for his legal career by earning a Bachelor of Science in journalism at West Virginia University in 1990, followed by a Doctor of Jurisprudence at the Thomas M. Cooley School of Law in Lansing, Michigan, in 1995. He has been admitted to practice law in both West Virginia and the Commonwealth of Pennsylvania as well as United States Federal Court in the Northern District of West Virginia. Other educational pursuits to Mr. Wagner's credit have included the completion of more than 800 hours of DUI defense training and instruction via specific training courses related to breath and blood testing, field testing, trial advocacy and countless national seminars related to DUI defense, science and courtroom skills. Mr. Wagner is also a qualified administrator of the National Highway Traffic Safety Administration standardized field sobriety testing protocol and a qualified instructor on standardized field sobriety testing, and has received training as a breath test operator of the Intoximeter EC/IR II, which is the official breath machine of West Virginia, along with that of Drug Recognition Evaluation training.
To better support his professional brethren, Mr. Wagner has been a long standing, proud member of both the National Criminal Defense Lawyers Association and the American Bar Association as well as the West Virginia State Bar Association. He is also a co-founder of the West Virginia DUI Defense Lawyers Association. Additionally, Mr. Wagner maintains an A+ rating as a member of the Better Business Bureau.
