Xin Tian, Esq. Gets the Star Treatment!

An accomplished lawyer and scientific researcher, Mr. Tian's professional experience so far has been fueled by his mission to bridge the gaps between the fields he is most passionate about—as well as the two cultures he has inhabited. Born and raised in Tianjin, China, he earned a Bachelor of Science in biotechnology at China Pharmaceutical University in 2009 and then a Master of Science in biology at New York University in 2011. He then launched his career as an electronic health record consultant at Technical Consulting & Research, Inc. in Weston, Connecticut—where he worked from 2011 to 2013.

It was in the midst of his second degree that he discovered the clashing of legal philosophies between the United States and China. In his home country, he was able to conduct several biological experiments on animals as it has a pro-research perspective on the practice, whereas those in America have pushed laws that ensure animals are protected from this and receive human treatment. This opened his eyes to the differences in legal systems among the two countries, which led him to enroll at the University of Minnesota Law School. He wanted to combine his expertise in biology with the law, and pursue interdisciplinary studies in order to find answers to the difficult legal questions he had. A legal intern at Thomson Reuters for two years, Mr. Tian ultimately obtained a Doctor of Jurisprudence in 2016 and became a licensed attorney in New York in 2018.

A research director at Beijing Qiansong Tech Development Co., Ltd. since 2018, Mr. Tian has utilized his specialties as a patent lawyer and new drug researcher to contribute to the advancement and commercialization of pharmaceuticals and technology. He believes that while the science research industry values creativity, the law tends to be stable for the purpose of maintaining social stability. Because, he noted, science will always develop faster than the law, new laws must be made in order to regulate new science research—especially when it comes to health care.

On the legal side, he arrived at his area of expertise from personal experience. An inventor of a "remote data-sharing and protection method" and a "data isolation-sharing method and device," both of which serve to monitor users' activity in order to prevent unauthorized access to sensitive and important digital data, he claimed that a major game company copy his idea and release an anti-addiction platform that disconnects its users if in proximity to certain locations. However, he noted that he used "patent invalidation," an effective weapon in the form of evidence that serves to invalidate the claims of a competitor's patent, in this case. He has excelled in the field of patent prosecution in China, arguing on behalf of fellow inventors for the granting of patent rights. In addition, he has found success in his work in comparative law research in regards to personal information protection across the United States, Europe, and China—in doing so, he strives to increase people's awareness of data ownership and the right to use data, provide insight on what would happen if no privacy laws existed, and strengthen the legal systems on an international level. "The comparative law research can help us to resolve similar problems in different countries," Mr. Tian said.

Another turning point for him was when he was hospitalized in a cancer hospital at China, where a doctor wrongfully diagnosed him with a lymphoma and prescribed three kinds of antibiotics—which brought about an acute kidney injury. He filed a malpractice lawsuit against the hospital, resulting in a loss and then an appeal to a higher court. The experience reinforced for him that the hospital was a state-owned enterprise and Chinese laws tend to protect such an institution's interests, even in medical malpractice cases. He said it gave him a better appreciation for the strengths of the United States' legal system and governmental protection of a citizen's human rights.

Outside of his primary endeavors, Mr. Tian has written articles for a number of professional publications, conferences papers for an IEEE Journal, and led presentations at numerous conferences on behalf of the IEEE. He also has a deep passion for the performing arts, Broadway shows, and filmmaking; in 2013, he directed a short film entitled "Lost in New York," which told the story of a Chinese girl pursuing her ballet dreams in the Big Apple. Fully committed to bringing his vision to life, he not only directed the film but also conducted extensive research, finessed the script, recruited the cast and crew, acquired shooting equipment, scouted locations, and figured out how to work within the budget. All this hard work paid off as in the following year, "Lost in New York" was recognized with an Award of Merit at the IndieFEST Film Awards. Looking toward the future, Mr. Tian hopes to establish a new company in New York City.
