In addition to his full-time responsibilities at the firm, Mr. Togut also serves as a senior advisor on all cases while also mentoring his talented team of staff attorneys.
A pioneer in his field, Mr. Togut has been instrumental in the firm's accomplishments. Winning a myriad of cases on behalf of clients, he has successfully served as a court-approved counsel on numerous occasions. Over the past 47 years, he and his group of highly trained professionals have successfully represented some of the most complex and high-profile Chapter 11 cases, including for such companies as General Motors, Chrysler Automotive, Enron, American Airlines, Latam Airlines and Frontier Airlines, among others. More recently, Mr. Togut was called upon to represent Westinghouse, Pacific Drilling and Toisa Shipping between 2018 and 2019 as the sole company counsel. Among his real estate cases, he was the lead counsel for Rockefeller Center Properties and Olympia & York's World Financial Center. He is currently counsel to Kenneth Feinberg who is the Court's estimation expert in the Johnson & Johnson LTL Chapter 11 case. Grateful for his unique success story, Mr. Togut has become highly regarded by bankruptcy judges and the U.S. Department of Justice, which he credits mostly to his strong sense of integrity.
Prior to forming Togut, Segal & Segal in 1980, Mr. Togut spent a summer working for Conrad Duberstein while pursuing his law degree. As head of the bankruptcy department of Otterbourg, Steindler, Houston & Rosen in New York, he was inspired by Mr. Duberstein's work and spent another six years at the firm after graduating. In 1980, shortly after Mr. Duberstein left the firm, Mr. Togut established his own successful practice.
Besides his commitments at the office, Mr. Togut has been a frequent speaker in the field. He has lectured throughout the country on behalf of the American Bar Association and the American Bankruptcy Institute, including at its international program in Europe. He also taught courses at the prestigious Harvard Law School. A prolific writer, as well, Mr. Togut has contributed dozens of articles in Forbes, the Norton Bankruptcy Law Advisor, the ABI Journal and other prominent publications on bankruptcy matters since 1977.
Alongside his work appointments, Mr. Togut is involved with civic organizations in support of his community. He served in active roles on the board of the Boston Symphony, the Williamstown Theater Festival and the Palm Beach Opera. He also chaired the board of the Berkshire International Film Festival for 10 years. He is also on an advisory board of the Rand Corporation.
Highly educated, Mr. Togut received a Bachelor of Science in economics, with honors, from New York University in 1971. Following this accomplishment, he received a Doctor of Jurisprudence from Saint John's University in 1974. Mr. Togut has been admitted to practice law by the New York Bar Association, as well as before the U.S. District Court for the Southern and Eastern Districts of New York, the U.S. District Court for the Eastern District of Michigan, the U.S. Court of Appeals for the Second Circuit and the Supreme Court of the United States.
Elected by his peers to highly prestigious invitation-only honorary groups, Mr. Togut is a fellow of the American College of Bankruptcy and the International Insolvency Institute. Throughout his career, he has also been active with several other organizations. Among them, he is a member of the New York City Bar Association and the American Bar Association. He is also a member of the Bankruptcy Lawyers of the Bar Association of New York and a past president and co-chair of the Commission of the American Bankruptcy Institute. Through this membership, Mr. Togut studied Chapter 11 reform. His recommendations led the U.S. Congress pass recent legislation to make it easier for companies to reorganize under the bankruptcy code.
In 2019, Mr. Togut was recognized for his leadership in corporate reorganizations by the Lincoln Center Corporate Council. He also received the Leadership Award from the New York Institute of Credit in 2011 and the Professor Lawrence P. King Award of Distinction from the UJA Bankruptcy Division in 2007. Additionally, his expertise has been recognized in several leading law publications, including as a New York Super Lawyer and as a Leading Lawyer by Chambers USA. Furthermore, he was profiled in the business sections of The New York Times and The Wall Street Journal and was recently quoted in the Bloomberg article, "Biden's Plans for Recovery Face Corporate America Debt Problem," where he addressed the country's economy in the face of the COVID-19 pandemic.
