Building on a career of almost 50 years, Mr. Burke currently operates as an independent mediator and arbitrator for his own company, Frank Burke Mediation and Arbitration PC, which he founded in 2017. He also provides arbitration and mediation services through the American Arbitration Association and to the public. Mr. Burke specializes in mediating and arbitrating disputes involving businesses of all sizes, focusing on the San Francisco, San Jose, Oakland, Sacramento and Southern California areas and providing virtual services internationally. He has built a reputation for doing intensive research before mediation, preparing outside-the-box approaches and relentlessly following up with involved parties. Before founding his own company, Mr. Burke gained years of experience as an attorney handling business trials at multiple firms, including Foley & Lardner LLP, Seyfarth Shaw LLP, Steptoe & Johnson LLP and Streich Lang. Mr. Burke spent five years as an Assistant U.S. Attorney for the United States Department of Justice, where he worked on tax fraud, antitrust, securities, mail, wire and bank fraud criminal investigations and trials as part of the economic crime enforcement unit. He gained foundational experience in the law as an associate attorney at Morrison & Foerster LLP and at Sherman & Howard.
In addition to his primary vocation, Mr. Burke has been active with several industry-related organizations. He is a member of the California chapter of the National Academy of Distinguished Neutrals, the American Bar Association, the State Bar of California, the Bar Association of San Francisco, the California Lawyers Association and California Arbitration. Mr. Burke serves as the co-chair of the Santa Clara County Bar Association's Section of Real Property and Business Law, and previously in the ABA Section of Litigation as Chair of the Corporate Counsel Committee and as Section CLE Chair, and as a member of the American Bar Association's Standing Committee on Continuing Legal Education.
A strong academic background has bolstered Mr. Burke's success throughout his career. He earned a Bachelor of Arts in Economics from Cornell University, graduating Magna Cum Laude in 1972. Mr. Burke completed a Juris Doctor at Harvard Law School in 1975. He has completed certification as an online mediator from Mediate.com and has been admitted to the bar in Arizona and California. Mr. Burke credits his accomplishments to lessons learned from his role models, a passion for helping his clients, and an unstoppable drive for excellence.
Throughout his career, Mr. Burke has shared his knowledge with others through numerous speaking events and written pieces. In 1989, he co-authored "The Corporate Litigator," a guide that has served as an essential resource for young business lawyers. Mr. Burke has made over 100 presentations at a wide range of webinars and conferences, providing detailed insight on civil litigation, business and real property, corporate governance and technology and cybersecurity issues, and more. Additionally, he has contributed articles to such industry publications as Law360, The American Lawyer, The Practical Litigator, Daily Journal, California Lawyer, The Recorder, West Law and more. Mr. Burke's contributions to his field have been recognized with many accolades; since 2007 he has been named one of the Best Lawyers in America and Super Lawyers in the areas of mediation, arbitration and commercial litigation.
Mr. Burke has long been dedicated to giving back to the community in the form of civic service. He volunteers as a mediator with the Santa Clara County Superior Court and United States District Court and is an active parishioner at the St. Raymond Catholic Church. Mr. Burke has been a member of the Mission Bay Yacht Club in San Diego for 35 years.
Outside of his professional life, Mr. Burke is a dedicated husband to Mary, his wife of 46 years, father to daughter Caitlin, son Tom and son in law Ted Blosser, all of whom are successful in business, and he is a grandfather to three grandchildren. He finds joy in sailing, traveling and spending time with his family. Looking to the future, Mr. Burke plans to enjoy family time and travel while continuing to work with his clients.
