OAI: Montana 'No Pay, No Play' Auto Insurance Bill Vetoed

The state's governor has said no to a measure that would have restricted the recovery rights of drivers without car insurance.



    RANCHO CUCAMONGA, CA, April 19, 2011 /24-7PressRelease/ -- Online Auto Insurance News is reporting that a controversial bill aimed at reducing the types of damages that uninsured motorists in Montana could claim after an accident has been vetoed by Gov. Brian Schweitzer. The proposed law, which had been approved by the state legislature at the end of March, highlights another reason why getting covered by a policy is so important.

"No pay, no play" insurance statutes make it so that drivers who hit the road without proper coverage and become victims of serious car accidents cannot successfully sue for non-economic damages, such as pain and suffering damages.

The reasoning behind this type of legislation is that drivers who do not fulfill their responsibility to purchase proper coverage should not have access to full recovery rights.

Opponents of the legislation said during debate that those who drive uninsured are those who cannot afford a policy from even the cheapest auto insurance companies on the market and that these people should not have restricted recovery rights as a result of their economic situation.

The state legislature passed the bill with narrow margins. Only 56 percent of the legislators voting on the bill approved of it.

Only a handful of states currently have "no pay, no play" laws on the books. Efforts to institute such laws are currently being considered by lawmakers in Minnesota, Oklahoma and Tennessee.
