Nursing Home Residents Rights

The NHRBR also guarantees a process for filing complaints, and quick investigations of all reports of abuse and neglect.

HUDSON COUNTY, NJ, September 21, 2011 /24-7PressRelease/ -- The New Jersey Office of the Ombudsman for the Institutionalized Elderly, a division of the Department of Health and Senior Services, has published a Nursing Home Residents' Bill of Rights (NHRBR) to be guaranteed by state law. This Bill of Rights is thorough in its inclusion of necessary considerations that must be made to protect against nursing home abuse, and provide an improved quality of life to our senior citizens.

New Jersey Nursing Home Residents' Bill of Rights
The Nursing Home Resident's Bill of Rights protects nursing home residents against all forms of abuse and neglect. It is intended to help seniors who require care to maintain dignity, justice, and personal freedom based on their emotional and mental needs. The NHRBR covers many areas including:

- Transfer or discharge
- Self-determination
- Access
- Privacy

The NHRBR also guarantees a process for filing complaints, and quick investigations of all reports of abuse and neglect.

Nursing home residents may have medical and mental concerns that are different from other seniors. Due to this, the care they need must be tailored to meet their unique needs, and provide them with personalized, compassionate care. The frail and needy residents of nursing homes deserve additional care and considerations, but are still entitled to the dignity and respect awarded to all of our senior citizens.

Federal Nursing Home Resident Rights
In addition to state laws, the federal government guarantees nursing home residents certain rights. These rights include:

- The right to be treated with dignity and respect
- The right to be informed in writing about services and fees before entering the nursing home
- The right to manage your own money or to choose someone else you trust to do this for you
- The right to privacy, and to keep and use your personal belongings and property as long as it doesn't interfere with the rights, health, or safety of others
- The right to be informed about your medical condition, medications, and to see you own doctor
- The right to refuse medications and treatments

When a nursing home fails to afford its residents these most basic rights, you also have the right to file a nursing home abuse lawsuit. With an experienced nursing home abuse attorney on your side, you can see that justice is restored, and you are granted the dignity you deserve.
