Universal City Nissan Sued by California Auto Fraud Lawyer

Prolific Southern California consumer law attorney sues Universal City Nissan for the allegedly illegal repossession of customer's automobile.

SAN DIEGO, CA, May 06, 2013 /24-7PressRelease/ -- Universal City Nissan, the popular Los Angeles, California Nissan dealership, has been sued by prominent Southern California auto fraud attorney Michael R. Vachon, Esq. for allegedly repossessing a consumer's automobile when it had no legal right to do so. The lawsuit alleges violation of California's automobile repossession laws, and was filed in the California Superior Court on April 23, 2013 (Case No. BC5067890).

Claims Made in the Lawsuit

The Complaint in the Harris v. Universal City Nissan lawsuit alleges that the defendant car dealership illegally repossessed a customer's recently-purchased 2013 Nissan Versa even though the customer, Ms. Charlotte Harris, had never defaulted on any of her payments. Harris asserts in her lawsuit that nearly two weeks after purchasing her new car she received a "Cancelation Notice" in the mail from Universal City Nissan in which the dealer claimed that it was entitled to cancel the contract based on an inability to obtain financing. Ms. Harris, believing that she had signed a legally-enforceable contract, refused to return the vehicle. According to the allegations in the Complaint, Universal City Nissan responded by repossessing Ms. Harris's automobile.

The California Superior Court has not yet determined whether Harris's allegations are true, and Universal City Nissan is expected to deny all liability and wrongdoing when it answers Harris's lawsuit.

Illegal Repossessions Are Not Uncommon

Harris's attorney, Michael R. Vachon, Esq., is a prominent Southern California lemon law and car dealer fraud attorney. Vachon states that complaints from consumers about illegal repossessions are, unfortunately, not that uncommon. According to Vachon "most consumers don't understand their legal rights, and don't have the training or education to understand the legalese that dealers jam into their purchase contracts. Accordingly, some unscrupulous car dealers act under the assumption that their customers will believe whatever they tell them." Vachon states that his law firm receives an average of two to four calls every month from California consumers complaining about illegal or unfair automobile repossessions.
