Stryker Hip Replacement Lawyers Note the Progression of Pending Cases in New Jersey State Court

A group of Stryker hip replacement lawsuits continue to proceed toward trials in a New Jersey state court.



    NEW YORK, NY, August 13, 2013 /24-7PressRelease/ -- A group of Stryker hip replacement lawyers notes with interest the progression of pending lawsuits consolidated into a multicounty litigation in a New Jersey state court.

According to court documents (In Re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation; MCL-296, Bergen County Superior Court), recent case management orders issued on July 26, and Aug. 3, respectively, said that counsel for the plaintiffs and defense must be mindful of certain topics such as trade secrets, and design information pertaining to the Stryker Rejuvenate and ABG II hip replacement implants in question, during the discovery phase of litigation. Moreover, certain cases were chosen for moderation to determine whether plaintiffs would accept settlements instead of going ahead with trials.

In addition to the consolidation of Stryker lawsuits filed in New Jersey state court, the Judicial Panel on Multidistrict Litigation (JPML) ordered the formation of a multidistrict litigation, according to court documents (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL-2441, U.S. District Court for the District of Minnesota).

"When these Stryker hip implant lawsuits were consolidated, it was not to create a class action, as some might assume," said Adrienne Brody, a Stryker hip replacement lawyer. Stryker Rejuvenate and ABG II hip implant devices were recalled in July 2012, but were under scrutiny from the U.S. Food and Drug Administration (FDA) for years prior, owing mostly to one alleged adverse side effect, "metal poisoning," or "metallosis." According to the FDA,* metal ions could enter into the patient's bloodstream because of friction between the devices' metal parts. This could lead to potentially severe health problems."
