The Law Office of Brian Murray Reports on Information Released Concerning the DACA Renewal Process

    ATLANTA, GA, May 13, 2014 /24-7PressRelease/ -- United States Citizenship and Immigration Services (USCIS) have released an update regarding the Deferred Action for Childhood Arrivals (DACA) program for the year 2014.

The initial grants of deferred action for early recipients of DACA from the USCIS are set to expire in September of this year. These grants were time sensitive and set to last for two years. USCIS has indicated that they are preparing for the DACA renewal process so that individuals who are eligible can request and receive an extension without experiencing any lapse in their lawful residence in the US.

USCIS will release a new multi-use Form I-821D, the Consideration for DACA form. The newly issued form will now serve two functions and can be filed for both initial and renewal requests for DACA. This updated form is scheduled to be released sometime in late May, according to immigration law firm The Law Office of Brian Murray.

Only individuals who received DACA from Immigration and Customs Enforcement (ICE) prior to August 15, 2012, will be eligible to request a renewal before the release of the new form. USCIS also indicated that there will be changes in evidentiary requirements for the renewal process. The only evidence that needs to be provided for renewal will be documentation relating to any removal proceedings (such as notices to appear) or any criminal history or activity that was not previously submitted to USCIS.

Renewal requesters should not file the current version of Form I-821D to renew as USCIS will not accept renewal filings until the new version of the form is officially released and published.
