SECAUCUS, NJ, August 14, 2014 /24-7PressRelease/ -- After years of litigation surrounding the NFL concussion lawsuits, a final settlement is close to being reached. The NFL increased how much it's willing to pay out, going from a $765 million total settlement cap in 2013, to a recent removal of the cap on how much the NFL will pay out. Final approval of the settlement is not guaranteed; several important steps must be reached before funds are distributed to retired NFL players involved in the lawsuit.
Three NFL Concussion Lawsuit Settlement Classes Based on Player Diagnosis
The NFL concussion lawsuit settlement is separated into three tiers, or settlement classes, based on the diagnosis the player has received. Potential monetary compensation for Level 1.5 and Level 2 ranges from a few thousand dollars to several million (currently Level 1 will not receive monetary compensation):
a.) Level 1: Retired players that have concussion-related symptoms such as depression, mood changes, sleep disorders, etc., who have not been diagnosed with Dementia, Alzheimer's Disease, Parkinson's Disease, ALS (Lou Gehrig's Disease).
b.) Level 1.5: Retired players that have been given a diagnosis of Dementia.
c.) Level 2: Retired players that have been given a diagnosis of advanced Dementia, Alzheimer's Disease, Parkinson's Disease or ALS or who have died and received confirmation of CTE (chronic traumatic encephalopathy).
"The sum result for retired, injured NFL players who have been given a diagnosis of Dementia, Alzheimer's Disease, Parkinson's Disease or ALS or who have died and received confirmation of CTE is that final approval of the settlement is now closer to being reached and monetary compensation is on the horizon," said Jeff Kahn, Managing Partner of Atlas Legal Funding.
