The FDCPA regulates debt collection conduct and insures that debt collection agencies refrain from harassing debtors in their attempts to collect debts. Debt collectors are required to utilize decent professional tactics when collecting debts. The state of Tennessee has adopted the FDCPA but calls it the Tennessee Collection Service Act (TCSA).

The regulation was enacted because of ongoing complaints about abusive, deceptive and criminally unfair debt collection practices being used by debt collectors in all industries. For a long time, the methodology used to collect debts was highly unregulated. Some collectors would lie about the authority they had to collect on the debt and the penalties involved, while others would personally threaten debtors. This law empowers the debtor and gives them a way to fight back if they are being treated improperly.

The regulation requires that debt collectors obtain a valid debt collection license before engaging in any collection activity and expressly conduct themselves according to the laid out law. Some of the highlights of the regulation dictate that debt collectors must not:

- Communicate with any debtor more than one time during a day.

- Use false identification or pretend to be an attorney or agent of law enforcement for purposes of collecting a debt.
- Threaten to sue a debtor.
