Brody issued an order requesting the N.F.L. to address five of the Judge's concerns about the proposed lawsuit settlement.

Good News for Players and Families

Judge Brody's requested revisions are designed to address the complaints of former players and their families expressed at a fairness hearing last November; they will expand the lawsuit parameters to increase the number of players eligible for benefits.

Here are Judge Brody's Proposed Changes:

1.) Provide eligible season credit for time spent in the World League of American Football, the N.F.L. Europe League and the N.F.L. Europa League.
2.) Remove the $75 million cap for the baseline assessment program, which is designed to determine how much a player's cognitive condition has declined and is available to all players.
3.) Extend the qualifying diagnosis of CTE (chronic traumatic encephalopathy) to include players who die up until final approval of the lawsuit, instead of the original date of July 6, 2014.
4.) Provide a hardship provision for the $1000 appeal fee for players of limited means.
5.) Allow a reasonable accommodation for players who do not possess medical records supporting their qualifying diagnosis due to force majeure events.

All parties involved have until tomorrow, February 13, to respond to the court by amending the proposed settlement to address these issues, or provide the court with an explanation as to why the parties are unwilling to agree to such amendments.
