Roofer Represented by Nichols Kaster, PLLP Files Overtime Lawsuit Against Simon Roofing & Sheet Metal Corp.

    CLEVELAND, OH, February 26, 2015 /24-7PressRelease/ -- A former employee of Simon Roofing and Sheet Metal Corp. filed a lawsuit in the Northern District Court of Ohio seeking overtime pay. The employee brought the case on behalf of roofers, roofing foreman, field support technicians, or in other positions with similar job titles, who worked for Simon Roofing & Sheet Metal Corp. nationwide within the last three years. In the employee's complaint, he alleges that while assigned to work at out-of-state job sites, the company failed to include travel time hours in his and other roofers' weekly overtime pay calculation. The complaint also alleges that while assigned to work at local, in-state work sites, Simon Roofing & Sheet Metal Corp. failed to include hours that the employee and others roofers worked at the company's service centers prior to arrival at their first job site of the day, in the roofers' weekly overtime pay calculation. The employee filed the lawsuit individually, and on behalf of all others similarly situated to recover uncompensated overtime and liquidated damages under the Fair Labor Standards Act (FLSA).

According to its complaint, Simon Roofing & Sheet Metal Corp. is one of the nation's commercial roofing companies that "manufactures innovative roofing products and provides high-quality roof repair, restoration, and replacement services", and operates at least 64 service centers throughout the United States.

Plaintiff's attorney Paul Lukas stated, "The primary claim is Simon Roofing's simple failure to include all hours worked in the roofers' weekly overtime calculation. This violation of law is evident on the face of the employees' paystubs and should not be particularly controversial."
