SECAUCUS, NJ, March 17, 2015 /24-7PressRelease/ -- Atlas Legal Funding today announced that the existing DePuy Articular Surface Replacement (ASR) hip settlement has been extended to include those who had revision surgery on or before Jan. 31. This extension, which will include an additional 1,400 claims, went into effect on Feb. 20 when the Settlement Oversight Committee (SOC) and DePuy Orthopaedics, Inc., filed a joint status report with the U.S. District Court.
In the initial settlement agreement, reached in Nov. 2013, Johnson & Johnson and its DePuy division agreed to compensate approximately 8,000 eligible ASR patients who had revisionary surgery to replace failed DePuy ASR implants -- including ASR XL Acetabular Hip System and ASR Hip Resurfacing System -- before Aug. 31, 2013.
2015 Settlement Enrollment Now Open
Enrollment for the 2015 settlement is now open; deadline to enroll is May 1, 2015.
"If you had revisionary surgery after Aug. 31, 2013 and on or before Jan. 31, 2015, and were previously excluded from the DePuy ASR settlement program, this is good news," stated Atlas Legal Funding Managing Partner, Jeff Kahn. "But despite this good news of inclusion for more patients, the wait for funding will continue since claims will need to be submitted and processed before payments are disbursed."
Funds Disbursement Timeframe Unknown; Awards Average $250,000
It is difficult to estimate when DePuy ASR hip settlement payments will be disbursed. After the 2013 settlement, it took approximately one year for plaintiffs to begin to receive funding; some plaintiffs are still waiting. In the initial settlement agreement, plaintiffs were awarded an average of $250,000 for pain and suffering.
Those who were found to have suffered "extraordinary injuries," such as complications related to hip revision surgery, may also be able to obtain additional compensation and have all medical expenses covered under Part "B" of the settlement agreement. A number of factors play into the amount of the base settlement that a patient receives, including age, amount of time the ASR implant was in place, a plaintiff's weight, whether the plaintiff was a smoker -- and other various issues.
