A 17-year legal battle ends in a $21 million judgment against Nationwide Mutual Insurance Company for its bad faith handling of a $25,000 collision claim in the matter of Berg v. Nationwide. Just last month the verdict, entered last June, was affirmed after nearly a year of post-trial proceedings when the Berks County trial judge denied Nationwide's motion to set the verdict aside.
The trial court found that Nationwide placed its insured at risk to suffer injury or death to save itself money on a collision claim, concealed evidence, and paid $3 million to defend this dispute over a $25,000 collision loss, as part of a broader strategy to punish and deter contingency fee lawyers. Mayerson also proved Nationwide continued applying this litigation strategy after the Superior Court instructed it to stop in an earlier decision published in 2002.
This is the largest judgment in the history of Pennsylvania entered in favor of the insured, and against the insurer, for its bad faith handling of an insurance claim. Mayerson took the case to the Pennsylvania Supreme Court and the Pennsylvania Superior Court and won his client victories at both appellate levels. Nationwide continues to deny any culpability and has filed another round of appeals. Mayerson brings 21 years of legal experience to his representation of victims of personal injury.
