James W. Marshall, III Recognized for Excellence by Capital Who's Who

Marshall, III is the newest member with the law firm of Bailey & Wyant, PLLC, a full service law firm with offices located in Wheeling and Charleston, WV, as of January 1st, 2016. Jim specifically offers legal representation in multiple areas including but not limited to: construction defects, employment law, constitutional law, asbestos litigation, mass torts, toxic torts, professional liability, personal injury, product liability, Fair Labor Standards Act, insurance coverage and general insurance defense.

Jim received his Bachelor of Arts Degree in Political Science from West Virginia University. Continuing his education, Mr. Marshall completed over 60 hours toward a Master's Degree in Public Administration at West Virginia University's Department of Public Administration before attending West Virginia University College of Law and receiving his Juris Doctor in 2006. He was a member of the West Virginia Moot Court and represented West Virginia University at the 2006 Mardi Gras Sports Law Competition, an appellate competition focusing on sports law-related topics. He has volunteered his time since graduation to help judge the WVU moot court competition.

Jim was a great asset to the firm as an associate for 8 years. He gained significant experienced as a litigator and legal advisor. He has spoken to large companies and groups dealing with specific aspects of legal issues related to their companies as well as relevant changes to applicable legal standards. As president of the associate committee at Bailey & Wyant, Mr. Marshall also assisted young lawyers in the development of their skills as well as the use of their talents and knowledge.

Jim's day-to-day responsibilities with the firm involve meeting with clients, preparing written discovery, drafting various briefs, taking and defending depositions, trial preparation, witness preparation, investigation of legal claims and timely reporting litigation updates to clients and their respective case handlers. He is an integral member of the successful team that makes up Bailey & Wyant.

Jim is a member of the West Virginia Chamber of Commerce, the West Virginia Defense Trial Counsel and the Defense Research Institute (DRI). He is licensed to practice by the North Carolina State Bar and the West Virginia State Bar. He is also admitted to practice in the United States District Courts for the Southern District of West Virginia, the Northern District of West Virginia, the Eastern District of North Carolina, and the Western District of North Carolina as well as the United States Circuit Court of Appeals for the Fourth Circuit. Mr. James W. Marshall, III is an asset to his employer and the clients he serves. He continues to diversify his areas of practice and clientele.
