9/11 Victims Compensation Fund, Zadroga Act, Extended & Renewed; Legal Funding Available Now for Eligible Parties

Congress Passes Legislation that Renews the 9/11 Victims Compensation Fund; $4.6 Billion in Funding Available



    SECAUCUS, NJ, January 14, 2016 /24-7PressRelease/ -- Atlas Legal Funding today announced the availability of legal funding for those eligible for the 9/11 Victims Compensation Fund (VCF), also known as the James Zadroga 9/11 Health and Compensation Reauthorization Act.

Under the renewal and extension, congress will continue to provide medical monitoring and treatment for injured and ill 9/11 responders and survivors. It will also make individuals and relatives of deceased individuals that were injured or killed in the rescue and recovery efforts after the aircraft crashes of Sept. 11, 2001, eligible for compensation.

9/11 Victims Compensation Fund Claims Now Fully Funded

The renewal of the Zadroga Act means that the 9/11 VCF claims will now be fully funded.

Previously, there was a set amount of money in the fund and all claims were processed and awarded a dollar amount to be paid. Other than 10 percent of the award amount that was paid out in the interim, all payments were on hold until all claim values were given and added up. At that time, if the total claim values exceeded the money in the fund, everyone's compensation would be prorated down to fit into the amount of money available in the fund.

With the renewal, Congress has removed the cap on payments for people who have already received an award letter prior to the passage of the renewal act; now everyone in that situation will receive the full award amount.

Caps and Limitations Under the Extension and Renewal

Under the extension and renewal of the act, there are certain caps and limitations that will apply to any applicant who has not received an award letter before the day of enactment. The Special Master is required to re-evaluate the policies once a year to ensure that spending and award determinations prioritize those suffering from the most debilitating conditions.

These caps and limitations include, but are not limited to:

- The codification of the legal definition for the exposure area; the area will be the same as that used by the current VCF program but would take an act of Congress to expand the area in the future.

- Under non-economic loss awards, cancer claims will be capped at $250,000 and non-cancer claims capped at $90,000.

- The yearly salary maximum for the calculation of economic awards will be capped at $200,000 per year.
