3rd Circuit Court of Appeals Denies En Banc Review of NFL Settlement Case

The appeal, which was brought about by roughly 200 former players, states that the lawsuit does not include living former players who may have chronic traumatic encephalopathy (CTE), which has been linked to concussions.

The settlement does address other injuries caused by head trauma. Medical experts have stated that about 30 percent of the 21,000 former players, or roughly 6,000 retirees, are expected to be diagnosed with Alzheimer's disease or moderate dementia. Compensation Timeline for Former Players Still Unknown; Possibility of Case Moving to Supreme Court

As of now, the lawsuit's duration and timeline for completion is still unknown. There is a possibility that the case will be appealed to the Supreme Court. In order for that to happen, an appeal must be filed within 90 days of April 18, 2016 -- the original date that the 3rd circuit appellate court approved the settlement.

If an appeal is filed within this 90-day timeframe, the Supreme Court will decide whether to hear the case and render a decision -- or deny hearing the case. If the Supreme Court denies hearing the case, at that point all appeals will have been exhausted and the settlement can finally move into the claims process and players will begin to be compensated.
