NORFOLK, VA, November 04, 2016 /24-7PressRelease/ -- The personal injury law firm of Kalfus & Nachman announced on Thursday that a client injured in a 2013 car accident has been awarded $1.5 million by a Hampton Circuit Court jury. Attorneys Richard Aufenger III and Thomas Fitzgerald II represented injured plaintiff Lisa Chandler, who suffered two broken bones in her left foot after being rear-ended on Interstate Highway 64 in a suspected distracted driving accident.
"Most people associate car accident lawsuits with life-threatening injuries," said Paul Hernandez, attorney at Kalfus & Nachman. "However, debilitating trauma to extremities like the feet is not uncommon in a car crash. These injuries can severely and permanently alter a victim's day-to-day life."
Chandler underwent surgery to repair the bones in her foot, and is planning to undergo a second procedure. Despite this treatment, Chandler is "expected to have foot pain the rest of her days," according to an article in the Daily Press, the newspaper of record in Newport News and Hampton, Virginia.
"Everyone uses their feet every day when they get out of bed, and that's what drove this verdict," Fitzgerald told the Daily Press. "When she gets out of bed, her foot is going to hurt."
Fitzgerald noted that the size of the $1.5 million verdict was "very deserved but still surprising." However, he believes that the jury recognized the impact that chronic foot pain has on Chandler's life, a reality Fitzgerald equated in his jury arguments to being perpetually unable to remove an annoying pebble from one's shoe.
Kalfus & Nachman is a longtime sponsor of the End Distracted Driving (EndDD) program. EndDD strives to raise awareness of the dangers of distractions such as mobile phone use, grooming, eating and interacting with passengers while behind the wheel. The campaign also seeks to discourage parents from engaging in distracted driving so their children don't emulate the behavior.
"Programs like End Distracted Driving present a chance to save lives, and we are proud to be a part of it," Hernandez said. "Ms. Chandler's case provided Kalfus & Nachman the opportunity to help somebody who has been significantly impacted by a safety issue that is a major focus of our firm's community involvement."
