MINNEAPOLIS, MN, March 29, 2017 /24-7PressRelease/ -- On March 21, 2017, a Fair Labor Standards Act (FLSA) Complaint was filed in federal court in the Eastern District of California against Barco, Inc. The named Plaintiff is a customer service engineer who is currently employed by Barco. His overtime claims are filed individually and on behalf of other similarly-situated employees, including other customer service/field service engineers, and employees in similar positions who worked for Barco anywhere in the United States during the past three years. The Complaint alleges that, despite complaints from the named Plaintiff about working unpaid overtime hours, Barco willfully continued to deny him and other similarly-situated employees overtime pay by improperly classifying them as exempt from the FLSA's overtime protections. The Complaint alleges that the named Plaintiff and the other customer service/field service engineers performed non-exempt work, including installing, repairing, replacing parts, troubleshooting, servicing, and performing preventative maintenance on equipment manufactured by Barco. Barco pays its customer service/field service engineers a salary with no overtime premiums to compensate them for the many overtime hours they work. The Plaintiff seeks to recover overtime back wages and double damages.

The company has operations in North America, Europe, and the Asian-Pacific. It offers products including displays, monitors, projectors, work stations, video walls, image processing, and others. Rebekah L. Bailey, who represents the plaintiffs stated, "Field service engineers typically work long hours without receiving overtime compensation and without qualifying as exempt from the law. We seek to recover the overtime premiums they deserve."
