Baker & Gilchrist Wins $2.5 Million Medical Malpractice Jury Verdict

    AVON, IN, April 12, 2017 /24-7PressRelease/ -- The Indiana medical malpractice law firm of Baker & Gilchrist secured a jury verdict of $2.5 million on Friday for a stroke victim who fell and suffered serious injuries during rehabilitation at St. Vincent Anderson Regional Hospital in Anderson, Ind.

Mr. William Owens had been sent to St. John's Regional Balance Center for outpatient rehabilitation in October 2011 after suffering a stroke, which left him at a high risk for falls. However, despite the evaluation that he was a high fall risk, a staff therapist failed to take reasonable precautions to protect the 64-year-old patient from a fall that resulted in life-altering injuries. As a result of the facility's negligence, Mr. Owens will need 24-hour care for the rest of his life.

After hearing the overwhelming evidence, a jury returned a verdict for $2.5 million late Friday. Mr. Owens' family is satisfied with the verdict. They are pleased the Hospital has been held accountable, and they hope it will prevent other patients in the future from being injured in the same way.

"Considering his past bills and his future bills for lifetime care will exceed $1.5 million, it is unfortunate the verdict will be reduced by the judge to $1.25 million because of the cap on damages under the Indiana Medical Malpractice Act."

The case, William Owens v. St. Vincent Anderson Regional Hospital, was heard in Madison County Circuit Court 3.
