RALEIGH, NC, May 20, 2017 /24-7PressRelease/ -- Few know that an archaic North Carolina law prevents victims from revoking consent to sex after sex has begun. In an effort to bring attention to the obscure law and seek changes to it, the family law attorneys at Younce & Vtipil, P.A., in Raleigh have launched an online petition drive, the firm announced today.
Younce & Vtipil attorney Kristopher Hilscher appeared on CNN earlier this month with his client Amy Guy to speak out about North Carolina's outdated consent law. Amy Guy's estranged husband, Jonathan Guy, brutally raped her for more than an hour and a half - yet he could not be convicted of rape because she initially consented to sex before later repeatedly begging him to stop when things turned violent.
Instead of facing rape charges, Jonathan Guy pled guilty to two counts of misdemeanor assault on a female - a charge that carries a much shorter sentence than rape.
"What we need to do from here is draw some more attention to the issue," Hilscher said on CNN. He and Amy Guy lead a grassroots effort to bring North Carolina's rape and consent law in line with the rest of the country where victims can say "no" and withdraw consent after sex is underway.
A part of that effort includes urging state lawmakers to pass a bill to change the archaic law that was laid down in a series of state Supreme Court cases dating back to 1979. Past bills to address this issue, such as Senate Bill 505 in 2015 and Senate Bill 553 sponsored in March of this year, have been unsuccessful.
The attorneys at Younce & Vtipil hope to help change that by calling on North Carolinians to put pressure on legislators. As a part of that effort, the firm has begun an online petition drive on Change.org. The firm asks individuals to "sign this petition to show the North Carolina General Assembly that you are ready to see this archaic law changed."
