ROSELLE, NJ, October 09, 2018 /24-7PressRelease/ -- The Consumer Financial Protection Bureau (CFPB) was asked to investigate Mr. Cooper, a Mortgage Loan Servicing Company on October 3, 2018 by Charles O. Knights, Jr., Executor and siblings, beneficiaries of a home of the Estate of Charles Knights, Sr. alleging improper mortgage management activities including Escrow mismanagement and refusal of mortgage payments.
Mr. Cooper/Nationstar was ordered in 2013 by The Consumer Financial Protection Bureau (CFPB) to pay civil penalty for violating the Home Mortgage Disclosure Act (HMDA.) also Mr. Cooper/Nationstar settled with The New York Department of Financial Services for $17 million settlement to cover numerous violations of that state's financial laws. The CFPB last year fined Nationstar almost $2 million for Home Mortgage Disclosure Act violations as reported on May 11, 2018, in The National Mortgage News Publication when the CFPB warned the said company that charges over alleged violations of the Real Estate Settlement Act (RESPA) penalty may be coming. The company renamed itself from Nationstar Mortgage LLC to Mr. Cooper in an attempt to reimage a few years ago after these unfavorable occurrences.
The New Jersey Homeowner, Charles Knights Sr. Estate has also filed a Federal lawsuit against Mr. Cooper. Citing a series of breaches of legal procedures and management deficiencies. The Plaintiff, Mr. Charles O. Knights remarked; "Mr. Cooper/Nationstar Mortgage has used deceptive tactics including refusal of mortgage payments. We are seeking justice and will continue to exercise our legal rights. They have used their financial power to intimidate and cause irreparable damages to other people but the buck stops here," Mr. Knights said.
The Knights Family beneficiaries of a New Jersey Estate lawsuit which was filed with Docket number 3:18-cv-12085-FLW-DEA in US District Court, New Jersey against Mr. Cooper, the renamed mortgage servicing company once called Nationstar Mortgage over their claims of wrongful acts and allegations of fraud which has resulted in attempted foreclosure.
The homeowners allege, among other things, that Nationstar, now Mr. Cooper acted in prejudice to harm them by refusing to accept payment of mortgage and manufacturing reasons to foreclose. They also allege refusal of mortgage modification. Mr. Charles O. Knights, Jr. is the Executor and a Beneficiary of Estate Charles Augustus Knights, Sr., other Beneficiaries include Cheryl Knights, Brian Knights, and Raul C. Knights.
