The woman was sitting in the passenger seat of her stopped car at a train trestle underpass. The underpass was too narrow for vehicles to pass in both directions. The defendant, who was driving toward the woman and her husband, claimed he was temporarily blinded by the high beams on the plaintiff's car.
The driver overcompensated by swerving to the right, which caused his vehicle to strike the sidewall of the train trestle underpass, then careen off the wall directly into the plaintiff's stopped car.
The woman suffered neck and back injuries that required a cervical fusion surgery and a lumbar ablation and microdiscectomy surgery.
Disputing the Defense to Establish Liability
