What's The Difference between A Felony And A Misdemeanor in Florida?

While all crimes carry potentially steep consequences, the attorneys at Taracks & Associates say they aren't all made equal.

"A felony is a category of offense punishable by a minimum sentence of at least one year of imprisonment. This sentence requirement differentiates felonies from misdemeanors or summary infractions."

TAMPA, FL, January 25, 2024 /24-7PressRelease/ -- "Don't do the crime if you can't do the time" is a popular way of advising individuals to think twice before engaging in any illegal activity. The reason is simple—all criminal ventures carry undesirable penalties, many including jail terms. However, what amounts to "the time" isn't the same for everyone; it largely depends on whether the offense is a felony or misdemeanor.

In Florida, misdemeanors refer to offenses that are punishable by up to 1 year of imprisonment and a fine of $1,000. Misdemeanors are classified into first and second degrees. While first-degree misdemeanors carry the highest possible penalties in their category, second-degree misdemeanors are punishable by up to 60 days and $500 fines. Examples of misdemeanors include possession of cannabis, stalking, simple battery, improper exhibition of a weapon, disorderly conduct, and disorderly intoxication.

On the other hand, felony charges are more serious offenses than misdemeanors. A felony is a crime that is punishable by more than a year in prison. These include child abuse, aggravated battery, sex crimes, drug trafficking, carjacking, burglary, and possession of a controlled substance.

Felonies are classified into first-, second-, and third-degree felonies as well as life and capital felonies. Felonies of the first degree, like armed robbery, carry jail terms of up to 30 years and a $10,000 fine. Second-degree felonies are punishable by a maximum of 15 years in prison, while third-degree felonies result in up to 5 years' imprisonment. For capital felonies like first-degree murder, the offender can receive the death penalty, while life felonies may put them in prison forever.

"A felony is a category of offense punishable by a minimum sentence of at least one year of imprisonment. This sentence requirement differentiates felonies from misdemeanors or summary infractions, which are punishable by lesser sentences." says Attorney Barry Taracks.

Regardless of the category of offense, individuals in Florida are at high risk of a prison term if convicted. This is why they are always encouraged to seek the services of an experienced criminal defense attorney immediately after an arrest.
